Terms and Conditions of booking.
The following booking agreement is between Donna The Piper and the client who is booking Donna the Piper.
Definition of terms

Force majeure is hereby defined as an event that is completely outwith the control of either party that makes honouring the booking agreement impossible.

Engagement, booking and performance pertain to the employment of Donna The Piper to perform the Highland Bagpipe at an agreed location, date, time and duration.
·
Equipment is defined as the Highland Bagpipe, the musical instrument that Donna The Piper performs with.
Outfit is defined as the clothing worn by Donna The Piper during an engagement.
1.Deposit and booking confirmation Bookings made with more than 30 days until the engagement remaining.
·
You will be given a 7-day first refusal on a given date, during which time a deposit is required to confirm booking.
·
To confirm booking for your event, a
£50 non-refundable deposit is required to secure the booking.
·
Your booking will only be confirmed upon receipt of this deposit.
·
The deposit must be paid within 7 days of booking otherwise the date will be made available to other customers. Bookings made within 30 days of the engagement
·
You will be given a 7-day first refusal on a given date, during which time a deposit is required to confirm booking.
·
To confirm booking for your event, I will require a
50%
non-refundable deposit of the total cost.
·
Your booking will only be confirmed upon receipt of this deposit.
·
The deposit must be paid within 7 days of booking otherwise the date will be made available to other customers.

Bookings made within 7 days of the engagement A
75% non-refundable deposit will be required for all bookings made within 7 days of the event. This deposit will be required within 24 hours of initial enquiry.
Travel surcharges
·
All booking options have an inclusive travel allowance of 100 miles.
·
2. Balance
·
50% of the outstanding balance will due by 90 days of your event. You will receive an invoice from Donna The Piper for this amount.
·
The remaining 50% will be due between 7 days before and the day of the event.
·
All outstanding balance can be paid electronically or by cash.
No cheques will be accepted.
Details of this will be provided in all invoices.
3. Cancellations
Cancellations must be made in writing to Donna The Piper by Email.
Donna@donnathepiper.scot.
No Phone cancellations will be accepted for the safety of your booking !
Cancellations will be subject to certain fees:

More than 90 days prior to event:
25% of total outstanding contracted booking fee
·
31-89 days prior to event:
50% of total outstanding contracted booking fee
·
8
– 30 days prior to event:
75% of total outstanding contracted booking fee
·
7 days prior to event:
100% of total outstanding contracted booking fee
Except in the event of force majeure, all cancellations must be communicated to Donna the Piper with at least
24 hours’ notice.
No refund of booking fees will be given in the event of force majeure on the part of the client leading to a cancellation.
In the event of force majeure on the part of the client that leads to the engagement being cancelled, Donna the Piper will to try to accommodate a rescheduled appointment at a later date. This will be subject to
availability, and potentially subject to additional travel surcharge, if cancellation of the engagement occurs after Donna the Piper has arrived at the engagement venue.
Where a cancellation occurs and the accumulated balance received by Donna the Piper is below the required amount in respect to the cancellation fee of that given notice period, an invoice will be sent to the client to recoup
the necessary outstanding balance due.
4. General terms of booking Donna the Piper will operate within the following terms of employment: Donna the Piper will provide performance of the Highland Bagpipe as per the requirements of the respective engagement
adhering to the following conditions:
The client acknowledges and agrees that all preparations have been made to ensure that the performance venue does not pose a threat to the personal safety of Donna the Piper’s person, or his equipment/outfit.
If basic safety conditions are not met, Donna the Piper reserves the right to refuse performance until conditions are made safe or an alternative location has been identified. In this event no refund of booking fee will be made.
Donna the Piper will operate in accordance with climatic conditions deemed reasonable to the successful performance of the Highland Bagpipe.
Whilst every effort will be made by Donna the Piper to prepare for weather conditions, it will not be possible to combat all eventualities. In the event that the engagement takes place in inclement or extreme temperatures, appropriate
breaks and respite will be taken at the sole discretion of Donna the Piper
Donna the Piper will NOT be expected or requested to pass her equipment/outfit to a third party !
Donna the Piper will take no responsibility for any noise complaints or disagreements resulting from the performance of the Highland Bagpipe at the associated booking venue.
The client hereby agrees to make all arrangements and seek all permissions necessary for the performance of the Highland Bagpipe at the associated booking venue.
Donna the Piper Piper assumes no liability or responsibility for any hearing loss or damage on the part of the client or their guests as a result of the performance of the Highland Bagpipe.
The client hereby acknowledges that the instrument produces 100-130dB and assumes responsibility for the protection of their own hearing.
Donna the Piper has a current Equity Public Liability Insurance policy and will provide details of this upon request. Donna the Piper Piper will perform the tasks mutually agreed with the client as per conditions of section
5.
Particular Arrangements. Donna the Piper reserves the right to refuse to undertake any requests made that fall out with the conditions of the respective section of these terms and conditions.
In the event that Donna the Piper is unable to honour an engagement through ill health or force majeure, all efforts will be made on the part Donna the Piper to source a replacement Highland Bagpipe performer, at
the mutual agreement of Donna the Piper and the client.
In the unlikely event that no alternative can be located, Donna the Piper will provide a 100% refund to the client of all associated booking fees. In the case of all bookings, should the client decide at the time of the engagement
that Donna the Piper is not required for the full time period intially booked, no refund of money will be provided to the client.
5. Particular Arrangements
All bookings
The client agrees that all timings and arrangements for the respective booking will be confirmed and communicated to Donna the Piper by 7 days prior to the event, and that any changes within a 7-day period will be notified
to Donna the Piper as soon as they are known. In the eventuality that a booking takes place within 7 days of the event, the client agrees that all timings must be confirmed within 24 hours of the booking confirmation.
The client agrees that provision of a contact phone number will be supplied to Donna the Piper within at least 7 days in advance of the event for emergency contact purposes.
The client agrees that any special requests for the performance of any music must be supplied within 28 days of the booking date, to allow time for Donna the Piper to prepare any new material, if applicable. Failure to do so
will result in an inability to accommodate such requests.
For bookings that are made with less than 28 days until the event, it may not be possible to accommodate any such tune requests, and agreement to undertake any requests within this time period will be at the sole discretion of Donna
the Piper .
Weddings
The client agrees that specific timings of the wedding, i.e. ceremony commencement, guests’ arrival, arrival at a second venue (if applicable) will be communicated to Donna the Piper with at least 7 days’ notice, and any changes to
these arrangements must be communicated as soon as they are known.
With regard to weddings taking place in a church or other religious building, the client agrees that if performance of the Highland Bagpipe is required inside the building, it will be the responsibility of the client to seek appropriate
permissions from the officiant or administrator of the building for the Highland Bagpipe to be performed inside.
If the client decides during the engagement that Donna the Piper is required to perform beyond the agreed time period of the booking, this may be subject to an additional charge of £30 per hour with a minimum of 1 hour’s charge, and
will be at the sole discretion of Donna the Piper .
In the highly unlikely event that a wedding is cancelled on the scheduled day due to a change of heart on the part of the bride(s) or groom(s), full payment will still be required and no refund will be given.
Private and corporate engagements
The client agrees that the booking fee for an engagement will be based on a pre-determined time period.
If Donna the Piper is required or requested to perform longer than initially agreed (whether through a change of mind on the part of the client or through a delay in proceedings) this will result in an additional charge of £30
per hour at a minimum of 1 hour’s charge.
The client agrees that if Donna the Piper is required or requested to perform beyond the originally agreed time period of the engagement, the decision to do so will be at the sole discretion of Donna the Piper .
